This research project investigates the effective regulation of illegal phoenixing in the Australian building and construction industry. In doing so, the research examines the context, conduct and culture of the industry in light of illegal phoenixing and illegal phoenix activities. Further, it examines the current rules, legislations and regulation theories used by the regulatory agency under investigation to address this problem. It then analyses the concerned regulatory agency’s efficacy in dealing with illegal phoenixing considering the theoretical framework for effective regulation developed in this project, and it proposes a more appropriate solution for the industry given its culture, conduct and context. In addition, further recommendations are made to achieve better results for the concerned regulatory industry
